Pursuant to the terms of those certain Decrees of Sale from the Circuit Court of Spotsylvania County, Virginia, the undersigned Special Commissioner will offer for sale at a simulcast (online and in-person) public auction at the Spotsylvania County Board Room, Spotsylvania, Virginia, on Thursday, October 21, 2021 at 11:00 a.m., subject to the following terms and conditions, the following-described real estate:

TERMS OF SALE:  All sales are subject to the approval of the Circuit Court. A 10% Buyer’s Premium will be added to the highest bid and will become a part of the total sales price on each property.  The highest bidder shall deposit ten percent (10%) of the total sales price, by either cash or good check, which sum shall be credited toward the purchase at closing.  The balance of the purchase price, in cash or certified funds, shall be deposited with SunTrust Bank, General Receiver c/o Spotsylvania County Circuit Court Clerk, within fifteen (15) days of Court confirmation.  TIME IS OF THE ESSENCE. All properties will be conveyed by Special Warranty Deed, subject to any easements and covenants of record, and any rights of persons in possession. Interested parties may go upon the unimproved real estate for the purpose of making an inspection.

GENERAL TERMS OF SALE: All sales are subject to confirmation by the Circuit Court of the County of Spotsylvania. In the event a sale is not confirmed by the Circuit Court, be redeemed by the landowner, or have the sale reheard and found in favor of the landowner, the purchaser's sole remedy shall be return of any amounts paid by the purchaser towards the purchase of the parcel(s).   All properties are conveyed by Special Warranty Deed, subject to any easements, covenants, or conditions of record, and any rights of persons in possession, but free and clear of judgment liens and deeds of trust.  Properties are offered for sale as-is, where is, without any representations or warranties, either expressed or implied. A property may not have a right-of-way to a public road.  Properties are sold in gross and not by the acre.  The purchaser understands that the former owner of the parcel(s) may for good cause shown, within ninety (90) days from the entry of the sale confirmation in this matter, petition the Court to have this sale reheard. The highest bidder will be responsible for taxes beginning December 1, 2021 going forward.
